These Terms constitute a legal agreement between you and Maple Spark Labs Inc., the company that operates Droplet Learn ("we," "us," or "our"), a limited liability company registered in Ontario, Canada.
You must accept these Terms by clicking "I Agree" (or a similar affirmative action) during account registration. Browsing public pages of the website does not constitute acceptance of these Terms, but is subject to our Privacy Policy.
We may update these Terms from time to time. Section 16 explains how changes work and how we will notify you.
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to create an account and use Droplet Learn. By creating an account, you represent and warrant that you meet this age requirement.
If we learn that a user is under 18, we will terminate their account and delete their personal information in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.
Droplet Learn is an AI-powered micro-learning platform that delivers personalized daily lessons ("Drops") on topics you choose. Here's how it works:
The service is provided primarily through our web application at dropletlearn.com. Features, content, and availability may change over time as we develop and improve the platform.
Droplet Learn operates on a freemium model:
| Free tier | Pro tier | |
|---|---|---|
| Price | $0 | $9 CAD/month |
| AI-generated paths per month | 1 | 5 |
| Daily Drops | Unlimited | Unlimited |
| All core features | Yes | Yes |
| Pro features | No | Yes |
The specific features included in each tier are described on our pricing page and may change over time.
The free tier provides access to Droplet Learn with limited features at no cost. We reserve the right to modify, limit, or discontinue the free tier at any time with 30 days' notice. The free tier does not include a service level commitment.
When you subscribe to the Pro tier:
We may offer a 14-day free trial of the Pro tier for new users. When you start a trial:
IMPORTANT: Your Pro subscription will automatically renew at the end of each monthly billing period at the then-current rate, unless you cancel before the renewal date. The recurring nature of charges is disclosed here and at checkout.
You may cancel your Pro subscription at any time through your account settings. Upon cancellation:
You can cancel directly from your account settings at any time.
All subscription payments are generally non-refundable. However:
We may change our subscription pricing with at least 30 days' advance written notice sent to your account email. Price changes will take effect at the start of your next billing cycle after the notice period. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.

Droplet Learn is provided as a consumer service. We do not offer a service level agreement (SLA) or uptime guarantee. We will make reasonable efforts to maintain the availability of the service, but:
We are not liable for any interruption, suspension, or discontinuation of the service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DROPLET LEARN IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, EXCEPT FOR WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING UNDER THE CONSUMER PROTECTION ACT, 2002 (ONTARIO).
WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE. YOU ACKNOWLEDGE THAT YOU USE AI-GENERATED CONTENT AT YOUR OWN RISK AND AGREE NOT TO HOLD MAPLE SPARK LABS INC. LIABLE FOR ANY DECISIONS MADE BASED ON SUCH CONTENT.
Nothing in these Terms excludes or limits any warranty, condition, or right that cannot be excluded or limited under applicable law, including the statutory warranty that services will be of reasonably acceptable quality under the Consumer Protection Act, 2002 (Ontario) and any equivalent consumer protection legislation in your jurisdiction.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAPLE SPARK LABS INC., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:
MAPLE SPARK LABS INC.'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING BUT NOT LIMITED TO LIABILITY UNDER THE CONSUMER PROTECTION ACT, 2002 (ONTARIO), LIABILITY FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.
In plain language: If something goes wrong, our financial liability is limited to what you've paid us in the past year (or $100, whichever is higher). We can't limit liability where the law doesn't allow it, and your statutory consumer rights are always protected.
You agree to indemnify, defend, and hold harmless Maple Spark Labs Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

We may suspend or terminate your account at any time if:
Where possible, we will provide notice before termination and give you an opportunity to export your data. In cases of serious violations (fraud, illegal activity, or actions threatening the security of the service or other users), we may terminate immediately without notice.
Upon termination:
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You consent to the exclusive jurisdiction of the courts of the Province of Ontario, located in Toronto, for any disputes arising from these Terms. For consumers in Ontario and other Canadian jurisdictions, you retain all rights under applicable consumer protection legislation, including the right to participate in class proceedings.
We will not require you to participate in mandatory arbitration. In accordance with Section 8 of Ontario's Consumer Protection Act, 2002, any term requiring mandatory arbitration of consumer disputes is void.
Class action waiver (where permitted): To the maximum extent permitted by applicable law, you agree that any claims must be brought in your individual capacity and not as a class member in any class or representative proceeding. This waiver does not apply where prohibited by law, including for consumers in Ontario.
Before commencing any formal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at support@dropletlearn.com. We will work in good faith to resolve your concern within 30 days. If we cannot resolve the dispute informally, either party may proceed to the courts of Ontario.
Canada's Anti-Spam Legislation (CASL) governs how we communicate with you electronically.
By creating an account, you will receive transactional emails necessary for the service to function, including account verification, password resets, billing receipts, subscription renewal reminders, and security alerts. These are exempt from CASL consent requirements but will always include our identity and contact information.
We will only send you marketing communications (product announcements, feature highlights, educational content, promotions) if you expressly opt in. You can opt in during registration or at any time in your account settings.
Every marketing email includes a clear, free, and easy unsubscribe mechanism. We will process unsubscribe requests within 10 business days as required by CASL. Unsubscribing from marketing emails does not affect transactional emails.
We may modify these Terms from time to time. When we do:
If you do not agree with a material change, you may terminate your account before the change takes effect. Your continued use of the service after the effective date of a change constitutes acceptance of the modified Terms.
We will maintain a link to the previous version of these Terms for your reference.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Maple Spark Labs Inc. regarding the service and supersede any prior agreements.
Severability. If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions will continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. A waiver of any term is effective only if in writing and signed by the waiving party.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, reorganization, or sale of assets, with notice to you.
Force majeure. We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, government actions, internet or power failures, third-party service outages, or unavailability of third-party artificial intelligence services.
No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
Export control and sanctions. You represent that you are not located in, under the control of, or a national or resident of any country or territory subject to applicable trade sanctions, and that you are not on any applicable restricted party list.
Consumer protection savings clause. Nothing in these Terms is intended to limit, exclude, or modify any rights or remedies you may have under the Consumer Protection Act, 2002 (Ontario), the Competition Act (Canada), or any other applicable consumer protection legislation that cannot be limited, excluded, or modified by agreement. To the extent of any inconsistency between these Terms and mandatory consumer protection legislation, the legislation prevails.
